Understanding New York’s Clean Slate Act: A Fresh Start for Job Seekers and Employers

New York’s Clean Slate Act, effective November 16, 2024, is a landmark law that aims to support reintegration and fair employment opportunities by sealing certain criminal records after a designated waiting period. This change can impact hiring processes for employers across the state, especially in ensuring compliance and maintaining fair hiring practices.

What Does the Clean Slate Act Do?

The Clean Slate Act automatically seals eligible misdemeanor records three years after sentencing and felony records eight years after release or sentencing. This applies only if the individual has not reoffended within that time and has completed probation or parole. Records that will not be sealed include:

  • Out-of-state and federal convictions

  • Class A felonies (e.g., first-degree murder, terrorism)

  • Certain sex offenses

What This Means for Employers

For employers, sealed records won’t appear in background checks, and applicants with sealed records can answer “no” to questions about criminal history. Companies must ensure that hiring practices, including application forms and interview questions, reflect this new standard.

Employers in New York City should also follow the Fair Chance Act, which prohibits inquiries about criminal history until after a conditional job offer. Additionally, certain roles, such as those involving work with vulnerable populations, may still require background checks under specific legal exemptions.
